Reservation of Rights regarding AI and Digital Technologies

Musique Nomade (“we” or “our”) is committed to protecting the rights of creators, performers, and all those involved in the production of music and other creative content. This statement serves as a formal declaration of our reservation of rights regarding the use of our content in connection with artificial intelligence (AI) and related technologies.

1. Prohibition of Unauthorized Use

We explicitly prohibit any access, use, copying, reproduction, extraction, modification, or exploitation of any of our works or content (collectively referred to as "Our Content"), including but not limited to sound recordings, audiovisual works, musical compositions, lyrics, metadata, artwork, images, and the name, image, likeness and/or voice of our artists. This prohibition applies, without limitation, to the following activities, regardless of intent or purpose:

  • AI training, development, or commercialization;
  • Web scraping, data mining, crawling, ripping, or other automated processes, such as bots, crawlers and scrapers; or
  • The creation of datasets, derivatives, or extractions, or any similar purposes.

These activities are prohibited unless expressly authorized by us in a specific written licence.

2. Scope of Rights Reserved

We reserve all rights to Our Content under Canadian copyright law and all other applicable Canadian federal and provincial legislation and regulations, as well as all applicable international laws and treaties, including but not limited to:

  • Rights related to text and data mining, reproduction, adaptation, public performance and the communication to the public by telecommunication, including making the work available to the public;
  • Protections afforded under international treaties such as the Berne Convention and all other applicable bilateral or multilateral agreements.

We expressly reserve all rights in relation to all exceptions or limitations of copyright and other legal rights related to the use of our content for AI purposes under Canadian law, and under any applicable international laws or treaties.

No rights shall be implied or granted by virtue of the public availability of Our Content, any use must be expressly authorized by a written license. We expressly opt out of any use of our content for text and data mining, unless expressly authorized by a written license.

3. Global Application

This reservation of rights applies worldwide, ensuring that Our Content is protected in any jurisdiction where it may be used or exploited, including under exceptions or limitations that may be introduced for AI purposes.

4. Public Availability Does Not Imply Authorization

Even if Our Content is accessible through publicly available means (e.g., streaming platforms or online repositories), this does not constitute permission for use in AI-related activities. All such uses require explicit authorization through a specific written license.

5. Enforcement

Any unauthorized use of Our Content unreasonably prejudices our legitimate interests and conflicts with the normal exploitation of Our Content. We reserve the right to take any necessary legal or other action to protect Our Content and to enforce our rights.
